Understanding North Carolina AED Requirements
North Carolina’s AED framework centers on N.C. Gen. Stat. § 90-21.16 (the AED Access Act) and related statutes. These laws establish civil liability immunity for trained users and set requirements for AED programs in covered facilities.
Which Facilities Are Required to Have AEDs?
- Government buildings (HB 914) — all NC state government buildings must have AEDs, with mandatory training for state employees in those buildings
- Dental offices (21 NCAC 16Q .0302) — NC Dental Board code requires AEDs in dental practices
- Public K–12 schools (§ 115C-47(61)) — AEDs required in public school buildings
- All employers — subject to the federal OSHA General Duty Clause, which requires a safe workplace with reasonable emergency preparedness
Good Samaritan Protections
NC’s AED statutes provide civil immunity to trained responders who use an AED in good faith. Proper device maintenance and documented staff training are required to qualify — a device on the wall with expired pads does not provide protection.

What happens when our pads or battery expire?
GreenLight AED™ subscribers never have to think about this. We track expiration dates proactively and ship or deliver replacements before they expire. For other clients, we send advance reminders and can handle replacements at any time. An AED with expired consumables is not a functioning AED.
